1. Legal information

The company Servicios de Integración Fiscal de Escrituras Públicas, S.L.U., (hereinafter ‘SERFIDES’) is owner of the website http://www.serfides.com (hereinafter ‘the Website’), with its registered office at Calle Parque Empresarial Las Mercedes. Edificio 6, 2ª planta, C/ Campezo Nº 1, 28002 Madrid, holder of Corporate Tax Code B85852663, registered with the Mercantile Registry of Madrid, in volume 27325, sheet M-492352, section 8.

2. Conditions of use and access

This ‘Disclaimer’ regulates use of the Website service that SERFIDES makes available to Users of this Website.

The use of the Website and its content confers the status of User of the same (hereinafter, the ‘User’) and implies the acceptance of each and every one of the conditions included in this Disclaimer, in the version published at the time of access. The User is obliged to make diligent use of the Website, in accordance with the Law and this Disclaimer. The User must read this Disclaimer carefully each time they plan to use the website, as the conditions of use may be subject to change.

Access to the Website is free except for the cost of connection through the telecommunications network provided by the access provider contracted by the User.

SERFIDES reserves the right to interrupt, at any time and without prior notice, access to the Website, as well as to interrupt the provision of any or all of the services provided through the same, whether for technical, security or maintenance reasons, for failures in the electricity supply or for any other reason. SERFIDES does not guarantee the reliability and uptime of its Website, so the use of the same is at the User’s own risk.

The purpose of this Website is to provide all Users with information and services offered by SERFIDES. The design, presentation or configuration of the Website, as well as its content, may be modified at any time and without prior notice.

The information provided on this Website is intended to supplement and not to replace the advice that in any case must be obtained directly from the Notaries Public, as such information is insufficient for the User to make personal or business decisions.

4. Data capture forms

The use of certain SERFIDES services or requests may be conditioned to prior completion of the corresponding User registration forms.

All information provided by the User through the Website forms for the foregoing purposes or any other purposes must be truthful. To this end, the User guarantees the authenticity of all the data disclosed and shall keep such information updated. The User is responsible for any false or inaccurate information they provide and for any damages caused to SERFIDES.

5. Introduction of links to the Website

The Internet User who introduces links from their own pages to the Website must comply with the following conditions:

The link will only connect to the home page of the Website but may not reproduce it in any form (copy of the texts, graphics, etc.).

Pursuant to prevailing legislation, it is forbidden to establish frames of any kind that surround the Website or allow the content to be displayed through URLs other than those of the Website and, in any case, when such content is displayed together with third-party content unconnected to the Website and which:

6. Industrial and Intellectual Property

All the information contained in this Website as well as the graphic design, images, source codes, trademarks, trade names, denominations, articles, reports, etc., are subject to the intellectual and industrial property rights of SERFIDES or third parties.

Under no circumstance does access to the Website imply the waiver, transfer, assignment or licence of all or part of these intellectual or industrial property rights, nor does it confer any right to use, translate, adapt, alter, exploit, reproduce, distribute or disclose the content of the Website for commercial purposes without the prior and express authorisation of SERFIDES or the third-party owner of the affected rights. The User retains the right to view and obtain a copy in the cache memory of the User’s computer, as a transitional and accessory reproduction, without being authorised in any case to communicate it to third parties.

Infringement of any of the foregoing rights may constitute a breach of these provisions, as well as an offence punishable under Articles 270 et seq. of the Criminal Code.

7. Liability

SERFIDES will not be liable in the event of service interruptions, delays, errors or malfunction of such service caused by reasons beyond its control or due to the fraudulent or culpable action of the User or due to force majeure. Force majeure includes failures of third parties, operators or service companies, lack of access to third-party networks, acts or omissions by public authorities, acts produced as a result of natural phenomena, blackouts, etc., and the attack by hackers or specialised third parties affecting the security or integrity of the IT system, provided that SERFIDES has adopted all existing security measures pursuant to the state of the art.

In any case, irrespective of the reasons, SERFIDES shall not accept any liability either for direct or indirect damages, consequential damages and/or for loss of earnings.

SERFIDES is not responsible for the content and opinions of third parties that may be published on its website, or for the information contained on the websites of third parties that may be accessed through links or search engines on the website. This is because the function of these is to provide information to the User about the existence of other Internet sources of information on the subject, where they can expand on the information offered on this Website. Accordingly, SERFIDES will not be liable for the results obtained through such hypertext links.

When third-party web pages can be accessed through search engines or links, SERFIDES acts as a provider of intermediation services pursuant to Article 17 of Law 32/2002, of 12 July, on Information Society Services and Electronic commerce, and will only be liable for the content and services provided on the linked sites to the extent that it is actually aware of the illegality and has not deactivated the link with due diligence.

SERFIDES is unaware of the content and services of the linked sites and therefore it is not liable for the damages produced by the illegality, quality, failure to update, downtime, error and worthlessness of the content and/or services of the Linked Sites or for any other damage that is not directly attributable to SERFIDES.

SERFIDES is not responsible for the use made by the User of the Website services or of their passwords, as well as of any other material on the Website, infringing the intellectual or industrial property rights or any other rights of third parties.

SERFIDES is not liable for the damages that may be caused to the Users’ equipment by potential computer viruses contracted by the User as a result of browsing the Website, or for any other damages derived from such browsing. In any case, it is the User’s responsibility to have adequate tools for the detection and removal of harmful computer programs.

SERFIDES does not offer any guarantee of absence of errors in any of the content of its Website, and it does not guarantee the correction of any defect or the absence of virus and other harmful components on this Website or on its Server.
