II. The purpose of data processing.
To manage requests for information and queries made to SERFIDES.
III. Data storage time
The data will be stored until an erasure request is received from the user who has given their consent to the processing, or who exercises the right to object in the case of processing through the legitimate interest of SERFIDES, and in any case until the latter considers that the data are not necessary for the queries made, in accordance with applicable legislation.
IV. Legitimacy of Processing
The lawful bases of the processing of personal data by SERFIDES are as follows: with regard to users that send website forms it is their consent; and with regard to users that contact SERFIDES by any means to request a procedure or consultation it is the legitimate interest of SERFIDES.
On the data collection forms, there will be fields marked as mandatory, whereby if the user fails to furnish the corresponding data, SERFIDES may refuse to provide the corresponding service.
V. Recipients
The data will not be transferred to third parties, except when required by a court or the Public Administration in the exercise of its powers.
VI. Rights
The users’ rights are:
Right to request access to personal data relating to the data subject
Right to request rectification or erasure
Right to request restriction of data processing
Right to object to data processing
Right to data portability
The user may exercise the foregoing rights, free of charge, with respect to the data sent, by means of a written request sent to the postal address of SERFIDES or to the e-mail address info@serfides.com. Likewise, the user has the right to withdraw the processing consent given at any time by sending an e-mail. This does not affect the legality of the processing based on consent given prior to its withdrawal.
For the proper exercise of rights, a series of requirements must be met to verify the identity of the person exercising them. Accordingly, when applying to exercise such rights, the following minimum content must be provided:
Name and surname(s).
Photocopy of the National Identity Document (DNI) or any other means admitted in law that provides proof of identity.
In the case of legal representation, a photocopy of the representative’s ID document and the document substantiating representation of the third party.
The right being exercised, together with any documents substantiating such right.
Indication of the address for notification purposes.
Date and signature of the requesting data subject.
Documents substantiating the request, if any.
SERFIDES will respond to the data subject regarding the exercise of the right requested within one month from receiving the request. This period may be extended for a further two months if necessary, taking into account the complexity and the number of requests received. SERFIDES shall inform the data subject of any such extension within one month of receiving the request, setting out the reasons for the delay.
If SERFIDES fails to comply with the request, it shall inform the data subject without delay, and at the latest one month after receiving the request, of the reasons for its failure to act and of the possibility of lodging a complaint with a supervisory authority (Agencia Española de Protección de Datos, www.agpd.es - C/ Jorge Juan, 6, Madrid).
Where requests are clearly unfounded or excessive, in particular because of their repetitive nature, SERFIDES may charge the data subject a reasonable fee on the basis of the administrative costs incurred in providing the information or communication or in carrying out the requested action, or refuse to act with regard to the request.
